Article 2 — Applicability

These general terms and conditions of sale apply to all offers, orders and agreements concluded through the Vorm & Flow webshop (www.vormflow.be), including the sale of products and registration for workshops.

By placing an order or registering for a workshop, the customer confirms that they have read these terms and accept them without reservation.

Vorm & Flow reserves the right to amend these terms at any time. The version in force at the time of the order applies.

Deviations from these terms are only valid if agreed in writing and expressly.

Article 3 — Offer and formation of the agreement

All offers on the webshop are non-binding and subject to availability. Vorm & Flow reserves the right to refuse or cancel an order, subject to notification to the customer.

An agreement is formed at the moment Vorm & Flow confirms the order in writing by email. Any errors in the confirmation must be reported immediately.

The product images on the webshop are illustrative. Because Jesmonite products are handmade, colour, texture and finish may differ slightly from the products shown. This is inherent to the artisanal nature of the products and is not considered a defect.

Article 4 — Prices and payment

All stated prices include 21% VAT, unless expressly stated otherwise. Delivery costs are not included in the product price and are shown separately during checkout.

Payment must be made at the time of ordering using the payment methods offered on the webshop. The order is only processed after full payment has been received.

For workshops, payment counts as confirmation of registration. Without payment, the registration is not final.

In the event of non-payment or late payment, default interest of 10% per year is due by operation of law and without prior notice of default, as well as a fixed compensation of 10% of the invoice amount (with a minimum of €25), without prejudice to the right to higher compensation if the actual damage is greater.

Article 5 — Delivery

Products are delivered to the delivery address provided by the customer. The customer is responsible for the accuracy of the delivery details.

Delivery times are indicative and not binding. Exceeding the delivery time does not entitle the customer to cancel the agreement or claim damages, unless the delay exceeds 30 calendar days.

The risk of loss or damage passes to the customer at the moment of delivery to the customer or a third party designated by the customer.

If a delivery requires several attempts because the customer is absent, additional costs may be charged.

Article 6 — Right of withdrawal

6.1 Products

Consumers (not acting in the course of a professional activity) have the right to withdraw from the agreement within 14 calendar days of receiving the product, without giving a reason.

To exercise the right of withdrawal, the customer must inform Vorm & Flow in writing via [email protected] before the withdrawal period expires.

After notification, the customer has 14 calendar days to return the product. The costs of return shipping are borne by the customer, unless agreed otherwise.

The right of withdrawal does NOT apply to:

• products made to the customer's specifications or clearly personalised;
• products that by their nature cannot be returned;
• products that, after delivery, have become inseparably mixed with other products.

Refunds are made within 14 days of receipt of the return, using the same payment method as the original payment. Vorm & Flow may withhold the refund until the returned product has been received and inspected.

6.2 Workshops

For workshop registrations, a withdrawal period of 14 calendar days after purchase applies, provided the workshop has not yet taken place.

If the customer expressly requests that the workshop starts before the end of the withdrawal period, they waive the right of withdrawal for the part already performed.

In the event of cancellation by the customer, the following rules apply:

• Cancellation more than 14 days before the workshop: full refund.
• Cancellation less than 14 days before the workshop: no refund.

In the event of cancellation by Vorm & Flow (e.g. insufficient participants, force majeure), the customer receives a full refund or a voucher, at their choice.

Article 7 — Conformity and statutory warranty

Vorm & Flow guarantees that the products conform to the agreement and meet the customer's reasonable expectations, taking into account the handmade and artisanal nature of the products.

Consumers enjoy the statutory 2-year warranty in accordance with Belgian law (Book VI of the Code of Economic Law). A defect must be reported within 2 months of its discovery.

Not covered by the warranty:

• damage caused by improper use or normal wear and tear of the product;
• damage caused by external factors (humidity, extreme temperatures, impact);
• colour variations inherent to the handmade process of Jesmonite.

In the case of a justified complaint, repair, replacement or refund is chosen in consultation with the customer.

Article 8 — Liability

The liability of Vorm & Flow is in all cases limited to the invoice value of the order to which the complaint relates.

Vorm & Flow is not liable for:

• indirect damage, consequential damage or loss of profit;
• damage resulting from incorrect or incomplete information provided by the customer;
• temporary unavailability of the webshop due to technical faults or maintenance.

During workshops, every participant takes part at their own risk. Participants are themselves responsible for wearing appropriate protective equipment and following the safety instructions of the workshop leader. Vorm & Flow is not liable for injury resulting from failure to follow the instructions given.

Article 9 — Intellectual property

All content of the webshop (texts, images, logos, designs, product descriptions) is the property of Vorm & Flow or its partners and is protected by intellectual property rights.

No part of the content may be reproduced, distributed or made public without the prior written consent of Vorm & Flow.

Article 10 — Processing of personal data

Vorm & Flow processes customers' personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Belgian privacy legislation.

Personal data is used exclusively for performing the agreement, processing payments, customer management and – if the customer has given consent – for marketing purposes.

Data is not passed on to third parties, except for the fulfilment of the order (e.g. shipping partners) or a legal obligation.

The customer has the right to access, rectify, erase and port their data, and the right to object to processing. Requests can be sent to [email protected].

Article 11 — Complaints and dispute resolution

Complaints about products or services must be reported in writing as soon as possible, but no later than 30 days after delivery, via [email protected]. Vorm & Flow aims to handle complaints within 10 working days.

In the event of disputes between Vorm & Flow and a consumer, the customer can use the European Commission's Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr/.

Vorm & Flow is not obliged to take part in out-of-court dispute resolution, but will always try to find an amicable solution.

Article 12 — Force majeure

Vorm & Flow is not liable for shortcomings resulting from force majeure. Force majeure means any circumstance beyond the control of Vorm & Flow that temporarily or permanently prevents performance of the agreement, such as strikes, extreme weather, pandemics, fire, shortage of raw materials or supply problems at suppliers.

In the event of force majeure, the customer is informed as soon as possible and a solution is sought in consultation (e.g. postponement or refund).

Article 13 — Applicable law and competent court

Belgian law exclusively applies to all agreements with Vorm & Flow.

In the event of disputes, only the courts of the judicial district of Ghent have jurisdiction, unless mandatory legal provisions designate another competent court.

For consumers, the mandatory provisions of consumer legislation of their place of residence remain fully applicable.
