General Terms and Conditions of Sale

Article 1 — Seller Identity

Article 2 — Applicability

These general terms and conditions of sale apply to all offers, orders and agreements concluded through the Vorm & Flow webshop (www.vormflow.be), including the sale of products and registration for workshops.

By placing an order or registering for a workshop, the customer confirms having read these terms and conditions and accepts them without reservation.

Vorm & Flow reserves the right to amend these terms and conditions at any time. The version in force at the time of ordering applies.

Deviations from these terms are only valid if agreed upon in writing and explicitly.


Article 3 — Offer and Formation of the Agreement

All offers on the webshop are non-binding and subject to availability. Vorm & Flow reserves the right to refuse or cancel an order, with notification to the customer.

An agreement is formed at the moment Vorm & Flow confirms the order in writing by email. Any errors in the confirmation must be reported immediately.

Product images on the webshop are for illustrative purposes only. As Jesmonite products are handmade, colour, texture and finish may differ slightly from the images shown. This is inherent to the artisanal nature of the products and does not constitute a defect.


Article 4 — Prices and Payment

All stated prices include 21% VAT unless explicitly stated otherwise. Shipping costs are not included in the product price and are displayed separately during checkout.

Payment must be made at the time of ordering via the payment methods available on the webshop. Orders are only processed upon receipt of full payment.

For workshops, payment serves as confirmation of registration. Without payment, the registration is not final.

In the event of non-payment or late payment, interest of 10% per annum is due by operation of law and without prior notice, together with a fixed compensation of 10% of the invoice amount (with a minimum of €25), without prejudice to the right to claim higher compensation where actual damages exceed this amount.


Article 5 — Delivery

Products are delivered to the delivery address provided by the customer. The customer is responsible for the accuracy of delivery details.

Delivery times are indicative and not binding. Exceeding a delivery time does not entitle the customer to cancel the agreement or claim damages, unless the delay exceeds 30 calendar days.

Risk of loss or damage passes to the customer at the moment of delivery to the customer or a third party designated by the customer.

If a delivery requires multiple attempts due to the customer's absence, additional charges may be applied.


Article 6 — Right of Withdrawal

6.1 Products

Consumers (not acting in the course of a professional activity) have the right to withdraw from the agreement within 14 calendar days of receiving the product, without giving any reason.

To exercise the right of withdrawal, the customer must inform Vorm & Flow in writing at [email protected] before the expiry of the withdrawal period.

After notification, the customer has 14 calendar days to return the product. Return shipping costs are borne by the customer unless otherwise agreed.

The right of withdrawal does NOT apply to:

  • products made to the customer's specifications or clearly personalised;
  • products that cannot be returned by nature;
  • products that have been inseparably mixed with other products after delivery.

Reimbursement will take place within 14 days of receipt of the return, via the same payment method as the original payment. Vorm & Flow may withhold reimbursement until the returned product has been received and inspected.


6.2 Workshops

For workshop registrations, a withdrawal period of 14 calendar days from the date of purchase applies, provided the workshop has not yet taken place.

If the customer explicitly requests that the workshop starts before the end of the withdrawal period, they waive their right of withdrawal for the portion already delivered.

In the event of cancellation by the customer, the following rules apply:

  • Cancellation more than 14 days before the workshop: full refund.
  • Cancellation between 7 and 14 days before the workshop: 50% refund.
  • Cancellation less than 7 days before the workshop: no refund.

In the event of cancellation by Vorm & Flow (e.g. insufficient participants, force majeure), the customer will receive a full refund or a credit voucher at their choice.


Article 7 — Conformity and Legal Guarantee

Vorm & Flow guarantees that products conform to the agreement and meet the customer's reasonable expectations, taking into account the handmade and artisanal nature of the products.

Consumers benefit from the statutory guarantee of 2 years in accordance with Belgian law (Book VI of the Code of Economic Law). A defect must be reported within 2 months of discovery.

The following are not covered by the guarantee:

  • damage caused by improper use or normal wear and tear;
  • damage caused by external factors (moisture, extreme temperatures, impact);
  • colour variations inherent to the handmade Jesmonite production process.

In the event of a valid complaint, a solution will be agreed upon with the customer: repair, replacement or refund.


Article 8 — Liability

The liability of Vorm & Flow is in all cases limited to the invoice value of the order to which the complaint relates.

Vorm & Flow is not liable for:

  • indirect damage, consequential damage or loss of profit;
  • damage resulting from incorrect or incomplete information provided by the customer;
  • temporary unavailability of the webshop due to technical issues or maintenance.

During workshops, each participant takes part at their own risk. Participants are responsible for wearing appropriate protective equipment and following the safety instructions of the workshop instructor. Vorm & Flow is not liable for injuries resulting from failure to follow provided instructions.


Article 9 — Intellectual Property

All content on the webshop (texts, images, logos, designs, product descriptions) is the property of Vorm & Flow or its partners and is protected by intellectual property rights.

No content may be reproduced, distributed or made public without the prior written consent of Vorm & Flow.


Article 10 — Processing of Personal Data

Vorm & Flow processes customer personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Belgian privacy legislation.

Personal data is used exclusively for the performance of the agreement, processing of payments, customer management and — where the customer has given consent — for marketing purposes.

Data is not shared with third parties, except where necessary for the fulfilment of the order (e.g. shipping partners) or required by law.

The customer has the right to access, correct, delete and transfer their data, and the right to object to processing. Requests may be directed to [email protected].

Article 11 — Complaints and Dispute Resolution

Complaints regarding products or services must be submitted in writing to [email protected] as soon as possible, and no later than 30 days after delivery. Vorm & Flow aims to handle complaints within 10 working days.

In the event of a dispute between Vorm & Flow and a consumer, the customer may use the Online Dispute Resolution (ODR) platform of the European Commission: https://ec.europa.eu/consumers/odr/.

Vorm & Flow is not obliged to participate in out-of-court dispute resolution, but will always endeavour to find an amicable solution.


Article 12 — Force Majeure

Vorm & Flow is not liable for failures resulting from force majeure. Force majeure is understood to mean any circumstance beyond the control of Vorm & Flow that temporarily or permanently prevents the performance of the agreement, such as strikes, extreme weather conditions, pandemics, fire, shortage of raw materials or supply problems with suppliers.

In the event of force majeure, the customer will be informed as soon as possible and a solution will be sought in consultation (e.g. postponement or refund).


Article 13 — Governing Law and Jurisdiction

All agreements with Vorm & Flow are governed exclusively by Belgian law.

In the event of disputes, the courts of the judicial district of Ghent have exclusive jurisdiction, unless mandatory legal provisions designate a different competent court.

For consumers, the mandatory provisions of the consumer protection legislation of their country of residence remain fully applicable.
